BY ACCESSING, BROWSING, OR USING SUPERSTATS IN ANY WAY, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THIS SERVICE. YOUR USE OF THE SERVICE CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS, REGARDLESS OF WHETHER YOU HAVE READ THEM.

1. Acceptance of Terms

By accessing or using SuperStats ("the Service"), you automatically and irrevocably agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these terms, you must immediately cease all use of the Service.

We reserve the right to modify these terms at any time without prior notice. Your continued use of the Service following any changes constitutes your acceptance of the new terms.

2. NO REFUNDS POLICY

ALL SALES ARE FINAL. NO REFUNDS WILL BE PROVIDED UNDER ANY CIRCUMSTANCES.

  • All payments made to SuperStats are non-refundable
  • This includes subscription fees, one-time purchases, and any other charges
  • No refunds will be issued for unused portions of subscriptions
  • No refunds will be issued if your account is terminated for violation of these terms
  • No refunds will be issued for service interruptions, technical issues, or dissatisfaction
  • No chargebacks will be accepted - initiating a chargeback may result in permanent account termination and collection action
  • By making a purchase, you waive any right to request a refund for any reason

You acknowledge that you have had the opportunity to evaluate the Service before purchase and accept full responsibility for your purchasing decision.

3. Use of Service

SuperStats provides tools for social media analytics and data collection. You acknowledge and agree that:

  • You are solely and entirely responsible for any data you collect, scrape, or process using our Service
  • You must comply with all applicable laws, regulations, and third-party terms of service
  • You must respect the robots.txt files and terms of service of websites and platforms you interact with
  • You will not use the Service for any illegal, unauthorized, or malicious purpose
  • You are responsible for obtaining all necessary permissions and consents for data collection
  • SuperStats has no obligation to verify the legality of your activities
  • You assume all risks associated with your use of the Service

4. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW:

  • We make no warranties, express or implied, regarding the Service's reliability, accuracy, completeness, or availability
  • We make no warranty that the Service will meet your requirements or expectations
  • We make no warranty that the Service will be uninterrupted, timely, secure, or error-free
  • We make no warranty regarding the accuracy or reliability of any results obtained through the Service
  • We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement
  • Any data, content, or materials downloaded or obtained through the Service is at your own discretion and risk

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUPERSTATS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any direct, indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, business opportunities, or goodwill
  • Damages resulting from unauthorized access to your account
  • Service interruptions, downtime, or technical issues
  • Legal claims arising from your use of collected data
  • Third-party claims or actions of any kind
  • Any damages whatsoever, even if we have been advised of the possibility of such damages

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 30 DAYS PRECEDING THE CLAIM, OR $50, WHICHEVER IS LESS.

6. Indemnification

You agree to indemnify, defend, and hold harmless SuperStats, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Any data you collect, process, or distribute using the Service
  • Any claim that your activities caused damage to a third party

7. Account Termination

We reserve the absolute right to suspend, restrict, or terminate your account and access to the Service at any time, with or without notice, for any reason or no reason, including but not limited to:

  • Violation of these Terms of Service
  • Suspected fraudulent, abusive, or illegal activity
  • Behavior that may harm other users or the Service
  • Requests from law enforcement or government agencies
  • Extended periods of inactivity
  • Technical or security issues
  • At our sole discretion for any reason

Upon termination, no refunds will be provided for any reason. All provisions of these Terms that should survive termination shall survive.

8. Service Availability

We do not guarantee that the Service will be available at all times. We may modify, suspend, or discontinue the Service (or any part thereof) at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service. No refunds or credits will be provided for any service interruptions or discontinuation.

9. Intellectual Property

The Service, including all content, features, and functionality, is owned by SuperStats and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.

10. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration rather than in court. You waive your right to participate in a class action lawsuit or class-wide arbitration.

Any claims must be brought within one (1) year of the date the cause of action arose, or such claims are forever waived.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SuperStats operates, without regard to its conflict of law provisions.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
